Case over flavored-vaping products out of Richardson could make it to the US Supreme Court

A case over flavored vaping products is now under consideration by the US Supreme Court. The ruling could determine whether a Richardson company stays in business.

Trident Distribution says the Food and Drug Administration changed the rules for approval of flavored vaping products midway through the process. In arguments before the Supreme Court, Trident lawyer Eric Heyer says after suggesting the company did not need to do studies on how flavored vaping liquids are attractive to children, the agency suddenly required it.

While Trident claims the vaping products help wean adults off tobacco, the FDA says the same fruit-flavored vaping liquids actually attract and hook kids.

A ruling is expected by late Spring.
