A Dallas real estate developer says the state has abandoned its efforts to use eminent domain to seize the acreage that was once Fairfield Lake State Park near Palestine.

Shawn Todd's company has been in a legal battle with the Texas Parks and Wildlife Department which wanted to acquire the 5,000 acres Todd Interests planned to develop into a luxury development with lakefront properties.

Fairfield Lake State Park users pleaded with the state to take the property to keep it out of private hands, but now, Todd Interests says Texas Parks and Wildlife has agreed to forgo its power of eminent domain, paving the way for the private development to move forward.
