50-year old Mark Forkner of Keller is accused of deceiving the Federal Aviation Administration (FAA) and defrauding Boeing's customers of the 737 Max out of millions of dollars. He is trying to get the charges tossed before next month's scheduled trial.

Specifcally Forkner is accused of omitting important information about the new plane's automatic flight system in order to get the plane approved for sale and flight.

The indictment says because of Forkner's actions, critical information that pilots could have taken to prevent two overseas crashes had never been explained. And all 737 MAX jets had to be grounded.

Jury selection in the case is scheduled for March 4th with the trial to begin March 7th.
