Grand jury to decide if Prosper mayor should be charged for leaving the scene of a crash

McKinney Police say the mayor of Prosper left the scene of a crash December 6. They say Ray Smith was involved in a crash on Highway 380 near Hardin Blvd.

The McKinney Police Department says another car pulled in front of Smith, causing him to "slam on the brakes." They say a motorcycle behind Smith then rear-ended him.

"The motorcyclist failed to maintain a safe stop distance and collided with the truck," McKinney Police wrote in a statement.

While Smith was not at fault, police say he also did not stop.

"Our investigation found that Smith left the scene instead of stopping to determine if a person was involved in the accident and determine whether that person required aid, as required by law," their statement reads.

Rodney Carver went to the hospital in critical condition. His wife says he has been in a medically-induced coma.

"I'm very disappointed in this gentleman for leaving my husband abandoned in the street to potentially get run over again," Barbara Carver said.

Police say they used information from witnesses to find Smith. He told police he looked in his rearview mirror after the crash and saw nothing, so he thought the other person had driven away.

"I've been praying for him since that night," Smith says. "I'm a born-again Christian. I believe in Jesus, and I've been praying for him."

Because Smith did not stop, McKinney Police say "a Grand Jury referral for Accident Involving Personal Injury has been filed with the Collin County District Attorney’s Office."
