Appellate judge upholds injunction allowing school districts to require masks

Most school districts are doing away with their mask mandates with COVID-19 cases waning.

But thanks to a ruling by a Travis County appeals court, they can reimpose them if necessary - at least for the time being.

Judge Catherine Mauzy has upheld an injunction issued by a trial court, allowing 19 school districts across the state to require masks if necessary.

Districts in Dallas, Fort Worth, DeSoto and Crowley were among those which sued Governor Abbott and Attorney General Paxton over Abbott's order barring government entities from requiring masks.

In her 20-page ruling, Judge Mauzy stated that under the Texas Disaster Act, Governor Abbott does not have the authority to preempt orders issued by government entities, including school districts.

The ruling will almost certainly be appealed to the all-Republican Texas Supreme Court.
