Judge blocks Westlake data center vote after Keller residents sue

A Tarrant County judge on Monday temporarily blocked the Town of Westlake from voting on a development agreement for a proposed data center near the Keller border. The order came after nearby homeowners argued the project would cause imminent harm to their properties.

Judge Kimberly Fitzpatrick of the 342nd District Court issued the temporary restraining order at 3:01 p.m. Monday in a lawsuit filed by the Lakes at Marshall Ridge Homeowners Association and two residents, according to court documents reported by The Dallas Morning News and CBS Texas. The order prevents Westlake officials from holding a vote on, approving or taking any action on Resolution 26-25 for the Circle T Data Center.

Westlake Town Council had scheduled a special meeting Monday afternoon to consider the agreement. After the order was announced, the council tabled the vote until after a hearing set for 10 a.m. Aug. 26, officials said.

The proposed Circle T Data Center would include about 1.1 million square feet of buildings on roughly 88 acres off Highway 377. Plaintiffs say the site sits as close as a few hundred feet from backyards in Keller’s Marshall Ridge neighborhood. Westlake officials have previously said the land is already approved for a data center and that the development would be more than 1,200 yards from Westlake homes.

The lawsuit claims Westlake failed to give proper public notice for earlier planning and zoning and council actions in late 2024 and early 2025. The order does not decide the merits of those claims and expires in 14 days unless extended.

Keller residents have packed recent meetings to raise concerns about noise, water use, property values and quality of life. Keller Mayor Ross McMullin said the city will continue reviewing its options as the case proceeds. Westlake has described the project as an important investment.
