Testimony begins today in Denton County in the second attempt to try a former Tarrant County sheriff's deputy on a murder charge.

Jay Rotter is the former Tarrant County Sheriff Deputy who is accused of killing his wheelchair-bound girlfriend three years ago.

Records show the shooting happened at the couple's home in Denton. It was Rotter who called 9-1-1 to report the shooting. He claimed he was hugging Leslie Hartman when she grabbed his gun and shot herself. But investigators say there were irregularities to how that happened and that it did not support Rotter's story, including how he performed a factory reset on his phone as he was being interviewed about the shooting.

Investigators say Hartman had every reason to live, that her mother was sick at the time and that Hartman wanted to be there for her.

The first time the case was to be before a jury was last year when a mistrial was declared just as testimony was to begin. Prosecutors had not turned over all the evidence they had.
