Prosper's mayor could be in trouble with the law after leaving the scene of an accident.

McKinney Police say last Monday night the driver of a car turned in front of a truck driven by Mayor Ray Smith causing him to slam on his brakes.

A man riding a motorcycle collided with Smith's truck. But Smith drove off, telling police he wanted to follow the car that caused the accident and didn't realize a motorcycle had hit his truck.

Police did contact Smith that same evening and say he was not under the influence of drugs or alcohol. But since he left the scene of the accident, his case will be sent to a Collin County grand jury.

The driver of the motorcycle is still in the hospital.
