Appeals court upholds federal law requiring registration of gun silencers

Gun silencers made in Texas that stay in Texas still have to follow a federal regulation that all suppressors be registered, an appeals court says.

The conservative-leaning U.S. Court of Appeals for the Fifth Circuit backed the federal government in a Second Amendment case this week. The ruling supports a district court judge's ruling that said the Bureau of Alcohol, Tobacco, Firearms, and Explosives has the right to force anyone with a gun silencer to register it and pay an excise tax.

In 2021, Texas passed a law that said a suppressor made in Texas that stays in Texas is exempt from federal regulation. The law also said a Texas citizen could manufacture their own silencer if they used parts made in Texas.

However, in rulings, the courts have found that neither Texas nor three individuals had standing to bring the suit because they had not shown harm. They could possess or make a silencer -- they just had to register it
