Mandate issued in SB8 Texas Heartbeat Bill

The 5th Circuit, U.S. Court of appeals is ordering all lawsuits against SB-8 to be dismissed.

The greenlight has been turned on for enforcement of the new Texas Heartbeat bill.

In a short ruling, the 5th Circuit, U.S. Court of appeals is ordering all lawsuits against SB-8 to be dismissed.


"Having received the ruling of the Texas Supreme Court that named official defendants may not enforce the provisions of the Texas Heartbeat Act, S.B. 8, this court REMANDS the case with instructions to dismiss all challenges to the private enforcement provisions of the statute and to consider whether plaintiffs have standing to challenge," the ruling said.

"It's just kind of the final stamp of approval," said Kurt Schwarz, a civil rights attorney who has followed the bill and its legal challenges.

 "A court can write an opinion but a mandate is sort the stamp that says this can be enforced."

SB 8 is controversial because it allows individuals to sue anyone involved in an abortion and collect monetary damages.

Because it's a civil action, the Courts have ruled there is no Constitutional issue.
