
Lawyers in the death row case of Robert Roberson remain puzzled after an Anderson County judge unexpectedly recused herself from the case.
Senior District Judge Deborah Oaks Evans issued a one-sentence order last week recusing herself from further involvement in Roberson's case. The decision surprised Roberson’s defense team, who had previously objected to Evans presiding over the matter.
Roberson, convicted in the 2002 shaking death of his daughter, faced execution in October. However, a Texas House committee intervened, issuing a subpoena for Roberson to testify, delaying the execution. Although the stay has since been lifted, a new execution date has not been set.
The reason for Evans’ recusal remains unclear, leaving the future of the case uncertain as the state continues its pursuit of Roberson’s execution.
