
Texas on Wednesday carried out its first execution since the state halted the planned lethal injection of an Anderson County man whose legal battle continues.
Robert Roberson was scheduled for execution more than three months ago after being convicted in the 2002 death of his daughter. While courts upheld his conviction, a Texas House committee intervened in October, arguing that new evidence suggested Roberson was wrongly convicted based on disputed shaken baby syndrome science.
Lawmakers delayed the execution by issuing a subpoena for Roberson to testify, leading to a stay that has since been lifted.
The Texas Attorney General’s Office has asserted that Roberson will not be called to testify. Meanwhile, with recent changes to the Court of Criminal Appeals, Roberson’s legal team says it is preparing a new appeal.
