PHILADELPHIA (KYW Newsradio) — The 16-year-old accused of firing the gunshot that killed a Penn State student last month in South Philadelphia was arraigned on murder charges Thursday night. His alleged co-conspirator is expected to be extradited from Colorado soon, and now, another accomplice is wanted in connection with the case.
Kaiseem Smith turned himself in to police less than 24 hours after his alleged co-conspirator Azzubair Outen-Fleming was caught by U.S. Marshals in Colorado Springs, Colorado.
“Kaiseem Smith called a police officer he knew. He was with his attorney, and he surrendered right here in this building,” said Deputy Police Commissioner Frank Vanore.
Both 16-year-olds face murder, robbery and related gun charges in the shooting death of 22-year-old Billy Schmidt, who was killed around 1:30 a.m. on June 6 at 20th and Wolf streets after they stole his phone.
Police said Schmidt chased after the teens, and that’s when Smith turned and fired a fatal shot into Schmidt’s chest.
According to the affidavit, a third person, 19-year-old Kadafi Fleming, who is related to Azzubair, will face robbery, conspiracy, theft and obstruction of justice.
They believe he stole a car used to commit the robbery and subsequent murder, and then got rid of it afterwards. Kadafi is not in custody.
During the investigation, two others were arrested — one wanted for a violation of probation, and the other, Azzubair’s stepfather, 35-year-old Donte Abdulmalik, who authorities said drove Azzubair to Colorado.
