PHILADELPHIA (KYW Newsradio) — The man accused of accidentally shooting his 5-year-old son Monday morning inside their Olney home has been charged with aggravated assault, child endangerment and related gun offenses.

Nicholas Pagan is now back behind bars. The 29-year-old was under house arrest at the time of the shooting. He was wearing an ankle monitoring system for gun charges and wasn’t allowed to have a firearm in the house — or at all, because he was convicted in 2015 on drug charges.

Police said Pagan unintentionally shot his son in the hip with a handgun inside their home along Fischer Avenue, near Second Street.

Pagan’s friends were inside the home at the time of the shooting, authorities said. Home surveillance cameras show them leaving right after the shooting and before police arrived.

Pagan’s 9-year-old son was also in the house at the time.

The 5-year-old remains in the hospital.

A spokesperson for the Philadelphia District Attorney’s Office said Pagan is ordered to stay away from the victims. He faces significant prison time.

Pagan’s bail is set at $2 million, but prosecutors expect the courts will not allow him out anytime soon because of his prior offenses.
