o The Queen of pop says fans got what they paid for!
o Her lawyers are asking a judge to dismiss a lawsuit filed against her by two concertgoers who accuse her of “false advertising.”
o She and Live Nation were sued over the alleged delayed start time in January after her Celebration Tour stop in December at the Barclays Center in Brooklyn.
o The two plaintiffs claim that the December 13th show began at 10:30pm, despite the tickets advertising an 8:30pm start time.
o They say if they knew what time she would actually go on, they “would not have paid for tickets.”
o Madonna’s legal team say, “…that ticketholders who left the venue after 1 a.m. might have had trouble getting a ride home or might have needed to wake up early the next day for work. That is not a cognizable injury."
o They also found that one of the fans described the show as “incredible” in a Facebook post before they filed the lawsuit, meaning that the show “met or exceeded his expectations,” according to her legal team.
o They also said in the filed response that, “…no reasonable concertgoer—and certainly no Madonna fan—would expect the headline act at a major arena concert to take the stage at the ticketed event time."
o The plaintiff’s attorney will now file a response to the new motion to dismiss the lawsuit within 30 days.
