20 years in prison for 190 shooter

BUFFALO, N.Y. (WBEN) - The gunman who shot and killed a man on the northbound I-190 last July will spend the next 20 years behind bars.

Juan Colon, 22, faced a maximum of 25 years in prison after he was convicted of first-degree manslaughter last month for the killing of 25-year-old Angel Marcial.

Colon and Marcial were close and may have had a conflict over a girl last July. By chance, Colon noticed Marcial driving near the Niagara Street exit during rush hour on July 9. He drove up to Marcial's car from behind, then pulled out a gun and fired seven rounds into Marcial's car. Three bullets struck Marcial, including two in the head, and he died.

Marcial's mother was also in the car and was not injured in last year's shooting.

While Colon was originally charged with murder and faced life behind bars, Erie County District Attorney John Flynn explained that the jury may have been swayed in Colon's favor due to Marcial's troubled past, which the DA declined to elaborate on.

"The jury came to the conclusion that this was manslaughter instead of murder," Flynn said. "That's unfortunate, I believe. I would have liked to see life on the back end here. I got 20 years on the front end and I'm happy about that. That, to me, is satisfying to the family obviously, but I would have liked the life on the back end."

Flynn said it was unfathomable to see how the shooting was not intentional. He explained that the jury may not have liked Marcial because of information that came out in the trial. Marcial in the past was previously convicted on drug possession, burglary, and attempted bribery in 2015.

Colon declined his right to speak prior to his sentence and his attorney, Jessica Kulpit, described Colon as "the kind of man you'd want your daughter to date" while explaining that Colon worked full time as a landscaper in the area.
