
After failing to follow New York State Pause orders that require all non-essential businesses to withhold from opening, Gables Bar on Hertel Avenue in Buffalo has been closed.
Erie County Executive Mark Poloncarz announced the closing in Monday's Erie County briefing.
"The Department of Health issued a commissioners order to shut down Gables on Hertel Avenue in Buffalo after it appeared they were having an unofficial happy hour," Poloncarz said.
"That information of course will now be transmitted to the New York State Liquor Authority."
Gables became the third bar in Western New York to be closed down after bypassing the state-wide order. The two previous bars to be closed down had their liquor licenses suspended after being reported to Liquor Authority.
"I don't know why any bar would do this," Poloncarz said. "Maybe they think they can get away with it but we are getting a lot of calls into our call center with regards to bars that are operating illegally."
According to Poloncarz, a resident living in the area of Gables reported these illegal happy hours had been held every day.
An undercover sanitarian confirmed the report.
Erie County Health Commissioner Dr. Gale Burstein announced the restaurant will need to present a plan that shows the department, this will not reoccur with the development of new policies.
"Our sanitarians will review that plan when we receive it, and only then will we permit them to re-open for takeout service only," Burstein said.
"We will do this with any bar or restaurant we find serving food or beverages to people on the premises."
