Buffalo, NY (WBEN) A Cheektowaga man has been sentenced to probation after admitting to striking an autistic resident in a residential home. Another caretaker witnessed the incident.

37-year-old Derrick C. Warburton, II was sentenced to 4 years probation last week after pleading guilty to endangering the welfare of an incompentent/physically disabled person. On April 23, 2019 Warbuton was working as a behavior support technician at a residential facility in the City of Lackawanna, and providing care to a juvenile resident with autism when he intentionally hit and kicked the resident, who was in an aggressive state, while trying to calm and dress the victim. Another caregiver witnessed the incident.


Judge Sue Maxwell Barnes found Warburton guilty following a one-day bench trial on January 7, 2022.

An order of protection was issued on behalf of the victim, which remains in effect until 2027.
