
NEW YORK (1010 WINS) — The NYPD transferred a captain accused of sexually harassing a detective he oversaw and took no action to prevent him from abusing other women, according to a lawsuit filed Wednesday.
Capt. Brian Flynn allegedly sent pictures of his penis to Det. Michelle Almanzar, made lewd requests of her and retaliated against her when she refused to play along.
Her colleagues at the precinct knew about the harassing behavior, but did nothing to intervene, instead instructing Almanzar to “keep him happy,” according to the lawsuit.
The litigation accuses Flynn of harassing Almanzar over an 18-month period at the 50th precinct, which covers Riverdale, Spuyten-Duyvil and Van Cortlandt Village in the north Bronx.
The pictures he sent of his genitals and other pictures he sent of what appeared to be ejaculate on a napkin looked as if they were taken in the office at work, according to Almanzar. He also allegedly requested her underwear.
“I was going to give you a Commander’s Day if you just gave me your panties,” Flynn said in a text to Almanzar according to the lawsuit.
He allegedly offered her perks if she accepted his advances. When she blocked his phone number, he started retaliating by forcing her to stay late to redo paperwork or denying her time off requests, according to the suit.
In one instance when she blocked his number, he allegedly posted pictures of a rat in a costume with her name on it around the office.
Almanzar filed a complaint with the NYPD’s Equal Employment Opportunity division in November. The allegations resulted in Flynn's transfer to another precinct.
The court papers accuse the NYPD of having “taken no action to assure that defendant Flynn does not harass any other female employees.”
The day after his transfer, Almanzar said she found him waiting outside her precinct at 4 a.m.
Sergeants at the precinct chastised her for reporting the harassment, according to the lawsuit.
“You couldn’t just keep him happy, now look, we are all under the microscope,” they allegedly said.
Almanzar claims her colleagues have kept her off of investigations since she complained.
The lawsuit seeks unspecified damages.
