Former Minneapolis police officer Derek Chauvin is again asking for his state murder conviction in the 2020 killing of George Floyd to be overturned.
Chauvin and his legal team argue that the assignment of Minnesota Attorney General Keith Ellison to prosecute the case was "illegitimate."
They also argue that Chauvin's due process rights were violated because the Hennepin County District Court failed to convene a grand jury before any charging decision.
Previous legal efforts by Chauvin have been unsuccessful, including when The Supreme Court rejected an appeal of his conviction for second-degree murder.
Two other attempts for post-conviction relief have also been rejected.
Chauvin is simultaneously serving a 21-year federal sentence for violating Floyd's civil rights and a 22.5-year state sentence for second-degree murder.
