Minnesota Governor Tim Walz says he hasn't yet decided whether or not to remove the case of a state trooper charged with murder for shooting Ricky Cobb on Interstate 94 last summer from the Hennepin County Attorney's Office.
County Attorney Mary Moriarty has come under fire from a police fraternal organization and state Republicans who claim she dismissed a use of force expert's opinion in the case.
Speaking Monday, Walz says the situation is complicated.
"There's been statements and things that have have been in this from the beginning that are concerning," says the governor. "So, that option is always open."
Walz says he's spoken with legal experts about the case and says there's a lot of confusion and controversy. He says his priority is making sure it's handled fairly.
Also weighing in is Minnesota Attorney General Keith Ellison who told the Star Tribune his office is studying the situation.
"I still believe juries and I still believe jurors can do the right thing and justice can be served," Walz added.
In statement, Mary Moriarty says her office would be happy to meet with the Governor or his team to discuss any concerns they have about the rules of criminal procedure, which she says are the same rules her office follows and fulfills in thousands of cases every year.
"Otherwise, we will litigate this case in court, which is where it belongs," Moriarty said.
