SUGARLOAF TOWNSHIP — Residents of Sugarloaf Township voiced their concerns last night about the potential construction of a data center in their community during a special meeting of the Board of Supervisors. The meeting included an informational session on a legal concept known as the Curative Amendment Lawsuit.

Attorney Michael G. Crotty, who led the session, explained that state law requires townships to provide zoning for all types of land use. If a township's zoning ordinances do not include provisions for a specific type of use, such as a data center, developers have the right to challenge the municipality in court. Crotty noted that the issue could be elevated to the Court of Common Pleas.


Crotty acknowledged the community's opposition to the data center but stressed that, under Pennsylvania law, property owners have the right to use their land as they see fit. He advised the township to avoid a complete ban on data centers. Instead, he recommended that the Board of Supervisors establish specific regulations and "guiderails" that developers would be required to follow if a data center is built. This approach would give the township more control over the development process and ensure certain standards are met.
