Attorney for Michigan State Rep. Jewell Jones wants case thrown out after judge denies request for release

LANSING (WWJ) -- A Livingston County Court judge this morning denied a request to allow Michigan lawmaker Jewell Jones out on bond.

Rep. Jewell Jones, an Inkster Democrat, was arrested for drunk driving earlier in the year and had requested to be released so that he could be treated for alcohol abuse in an outpatient program.

Byron Nolan, Jones’s attorney, tells WWJ’s Michael Cohen he wants the entire case thrown out.

The next court hearing is set for November 4, at which time a judge will rule on motions filed by Nolan to dismiss the blood alcohol evidence, and all charges in the case.

“We’re challenging the legality of the arrest,” Nolan said. “Our position is basically Trooper Harden didn’t have the authority to arrest Mr. Jones and then charge him with resisting arrest. When you charge someone with resisting arrest, you have to have a right to arrest them in the first place.”

Nolan says that Jones’s refusal to provide troopers with his identification is not a criminal act, and so police did not have the right to arrest him.

Regarding the blood alcohol evidence, Nolan says the search warrant was obtained after providing the magistrate with inaccurate information, and should therefore be thrown out.

Jones's drunk driving, reckless driving and resisting arrest charges are related to an incident on I-96 last April, when he was pulled over with a blood alcohol content of 0.19, the police report said.

Since that time, officials say Jones has violated the conditions of his bond three times.

Additional attempted escape charges were filed after Jones was caught with a jail key allegedly taped to the bottom of his foot.

Jones was ordered to remain in jail last month after admitting to violating the terms of his bond.
