TROY (WWJ) -- An Oakland County man faces charged under Michigan's "Super Drunk Laws" after police say he fell asleep while driving on John R. Road last week.

Troy Police were patrolling the area shortly before 6 p.m. on Wednesday, Feb. 22, at the intersection of John and Long Lake Road, when they saw a 2022 Ford Expedition stopped at a green light.

When they approached driver, later identified as a 45-year-old Troy resident, officers discovered that was "passed out at the wheel."

After several minutes of loud knocking on the windows, the driver finally woke up "but did not comply with the officers' continual commands to open the door," according to the police report.

Police said that's when officers forced entry into the SUV.

The driver, who smelled strongly like booze, was unsteady on his feet, couldn't stand up without help and was unable to complete a field sobriety test.

The driver was arrested and taken to the Troy Police Lock-Up Facility where a chemical breath test showed he had a .31% BAC (blood alcohol concentration — which is more than three times the legal limit for driving.

The man was cited for Operating with a Blood Alcohol Content of .17% or More, police said, before he was released to a local hospital for medical treatment.

Under the state's 'Super Drunk Laws,' drivers with a BAC more than twice the legal limit of .08% face stiffer penalties, a possible jail term of up to 180 days if convicted.
