FARMINGTON (WWJ) -- A former student is suing the Farmington Public School District and a teacher after she called him the "N" word.
A complaint filed in federal court last week claims teacher Ellen Ely called 17-year old Marcus Wells the racial slur in front of a classroom of students at Central High School in November 2019.
Lawyers for Wells say the incident happened after the student was threatened by a classmate and Ely intervened.
The suit also claims that Wells was suspended/expelled from school in 2019 because of his race.
The lawsuit, which claims Wells' civil rights were violated, is seeking damages of $5 million.
