ROCHESTER HILLS (WWJ) -- Felony charges have been filed against a Rochester Hills mother and her boyfriend after they failed to get help for a 4-year-old girl with a broken arm and leg.
The Oakland County Sheriff's Office says 26-year old Kimberly McGarry was arrested Tuesday near Grand Rapids by U.S. Marshals. She was arraigned in 52-3 District Court Thursday on first-degree child abuse charges.
Her boyfriend, 29-year-old Cleyde Murillo, was arrested and arraigned on first-degree child abuse charges last week.
The investigation into the alleged abuse started last December when McGarry's daughter was at the hospital, according to the sheriff's office.
The mother told investigators the child fell down steps two weeks prior, but doctors said the injuries weren't consistent with that type of fall.
After the hospital notified child protective services, officials said McGarry gave conflicting stories to detectives about how and when the injuries happened.
It was eventually determined that the girl had suffered the injuries more than a month earlier, on Nov. 15, and neither McGarry nor Murillo provided any medical attention for the child, potentially causing permanent injury to her, officials said.
McGarry's two other daughters are now with their father.
“There can be no excuse and no tolerance for anyone that abuses a child,” Oakland County Sheriff Mike Bouchard said, in a statement. “It is one of the more heinous crimes we encounter, and I am anxious for these suspects to be held accountable.”
McGarry had bond set at $150,000 bond with a 10% provision, which would allow her release after posting $15,000. Murillo had bond set at $750,000 bond with the 10% provision, which allows his release after posting $75,000.
If convicted, both Murillo and McGarry could be sentenced to life in prison.
