
(WWJ) – A Romeo man has been accused of using a chemical spray against police officers during the breach of the U.S. Capitol on Jan. 6.
The U.S. Department of Justice announced Wednesday 41-year-old Tim Levon Boughner has been charged with assaulting law enforcement with a dangerous weapon, engaging in physical violence in a restricted building or grounds, civil disorder and assaulting, resisting or impeding certain officers with a dangerous weapon.

Boughner, at least the 12 person from Michigan to be charged in connection with the Capitol riots, was arrested on Tuesday and made his initial federal court appearance in Detroit on Wednesday.
He remains held, pending a detention hearing on Thursday.
Agents say they have video showing Boughner among a crowd of rioters at the Capitol on Jan. 6. Around 2:33 p.m. that day, he allegedly used a chemical spray against officers.
That happened around the same time that people in the crowd were “throwing objects and deploying multiple chemical sprays against law enforcement officers who were attempting to secure the building,” the DOJ said.
Boughner allegedly used the spray again about a minute later, officials said.
Officials say he posted on social media later that day, saying he “started spraying” at the Capital and “f— those cops.”
In a different post made on Feb. 17, Boughner posted “I have to share. My life has not been the same since this day … I still don’t know how I ended up on the capital steps having a pepper spray fight with the capital police,” according to officials.
Boughner is one of more than 700 people to have been arrested in nearly all 50 states in connection with the breach at the Capitol. More than 220 people have been charged with assaulting or impeding law enforcement.
This case is being prosecuted by the U.S. Attorney’s Office for the District of Columbia and the Department of Justice National Security Division’s Counterterrorism Section. Valuable assistance was provided by the U.S. Attorney’s Office for the Eastern District of Michigan.
The case is being investigated by the FBI’s Detroit Field Office, along with the FBI’s Washington Field Office, which identified Boughner as #337 in its seeking information photos. Valuable assistance was provided by the Michigan State Police, the Metropolitan Police Department and the U.S. Capitol Police.
