Will justice prevail in the Bourbon St. killing?

New Orleans District Attorney Leon Cannizzaro today talked about the charges and the prosecution of 37-year-old Louis Barnes, the man arrested in connection with the shooting on Bourbon street early Sunday morning.  Cashiers, North Carolina

He explained how the law stands in this case.

"If Barnes has the gun and he intends to shoot, let's say the security guard, and he misses and shoots Ms. Couvillion,, that would be second degree murder,'' said Cannizzaro.

Other arguments could be made that it wasn't his fault, but Cannizzaro says Barnes criminal background will come into play.

"He had some serious charges in his background, he was classified as a sex offender," said Cannizzaro, "His most recent charge was failure to register as a sex offender."

For now, Barnes faces second degree murder and attempted second degree murder.
