Deadline for homeowners to sue over outstanding Ida claims

People who are still trying to settle their insurance claims from Hurricane Ida have one day left to decide if they are going to sue their insurers.

"After August 29th, there's no legal obligation to pay your claim," said Doug Sunseri, host of All Things Legal on WWL,

Sunseri says for insurance companies, it is like having the lead and possession of the football inside the two minute warning and you have no time outs left.

"And that's what, in essence, metaphorically happening right now," he said. "Insurance companies are waiting to see who files suit, knowing that probably a majority of unresolved claims will expire."

He says at that point, filing a lawsuit becomes the homeowner's only play.

"The litigation process is nothing to be intimidated by," explained Sunseri. "You'll be in a mediation process where you'll meet with the insurance company, exchange information, and probably about 95, 98 percent of the time, you cut a deal at the mediation and everybody walks away with something they can live with."
