Does the Second Amendment give illegal immigrants the right to bear arms?

Does the Second Amendment protect illegal immigrants the same way it protects American citizens? That's the question Don Dubuc asked while filling in for Newell Normand on WWL.

It came up because a U.S. District Court judge ruled in March that prohibiting illegal immigrants from possessing firearms is a violation of the Second Amendment.

DuBuc asked 'how is she suggesting that illegal immigrants acquire firearms?' because background checks ask you to confirm that you're a legal U.S. citizen. If they can't pass the background check, how could they legally possess a gun?

"What they're doing is basically saying they're going to ignore the law," answered guest Michael Letts, Founder, President & CEO of InVest USA. He added there's an agenda by activist judges to give illegal immigrants the same rights as citizens and this is just another example of that.

The ruling, issued on March 8 by Obama-appointed District Judge Sharon Johnson Coleman, was issued in the case of Heriberto Carbajal-Flores, who was charged under Title 18 of U.S. Criminal Code, a measure preventing illegal migrants from possessing firearms. Carbajal-Flores, who was here illegally, was discovered to have a gun in Chicago's Little Village neighborhood.

Carbajal-Flores contends that he received and used the handgun solely for self-protection and protection of property during a time of documented civil unrest in the Spring of 2020,” the judge wrote. “Thus, this Court finds that, as applied to Carbajal-Flores,[Title 18] is unconstitutional.”


This decision by a judge in the United States means one thing, Letts said.


"It's time for a change, it's time now," Letts said. He compared the battle to keep rights limited to U.S. citizens to the battles of World War II.

The thing they have in common is fighting for the right of freedom for all Americans, he said.
