The New Orleans Office of Inspector General says the city should give up its apartment in the Upper Pontalba building on Jackson Square.
"The arrangement gives the appearance of a donation of a public property in possible violation of the Louisiana constitution," said Inspector General Ed Michel.
Michel recommended the city relinquish the apartment to the French Market Corporation, in order to lease it to the general public.
NOLA.com reports there are currently 339 people on the waiting list for an Upper Pontalba apartment.
Should the city decide not to give up the residence, Michel said there needs to be clear rules establishing who is allowed to use the apartment, and when. He said there should also be guest logs to track visits to the unit.
