
(WBBM NEWSRADIO) — An Illinois state senator is renewing efforts to remove cannabis odor as probable cause to search a vehicle.
State Sen. Rachel Ventura introduced a measure that would prohibit officers from searching a vehicle, driver, or passenger without a warrant solely based on the odor of marijuana.
Instead, law enforcement would be directed to consider all factors – not just odor – in deciding if the law has been broken.
Ventura says the measure aims to clarify a "conflicting directive" issued by the Illinois Supreme Court last year. It decided two separate cases, but issued contradictory rulings on whether the scent of cannabis is a probable cause.
