Court to weigh whether convicted cop killer was fit to stand trial

(WBBM NEWSRADIO) — Jury selection is underway at the Cook County Leighton Criminal Courthouse to determine again whether a man convicted of killing an off-duty Chicago police officer was fit to stand trial.

Marcus Floyd, 30, was found guilty in 2015 of being part of the group that killed Thomas Wortham IV outside his parents' South Side home in 2010. Floyd had been wounded when Wortham's retired police officer father returned fire. Floyd's cousin accomplice was killed.

Floyd's lawyer alleged Floyd had amnesia about the crime and wasn't fit to stand trial. A jury found otherwise, later convicting him. Floyd was sentenced to life in prison.

The victim’s sister, Sandra Wortham, this week said she fears Floyd will be freed if a new fitness hearing finds Floyd “not fit” to stand trial.

"Our family’s just pretty devastated that we have to go through this again. Marcus Floyd was provided a fitness hearing with a jury in 2015 and they found him fit. We know the facts in this case are very clear so we’re devastated."

Sandra Wortham said she especially feels for her parents who are in their 70s and still don’t have full closure on their son’s murder.

"As a daughter, it is beyond me that my parents even have to think about Marcus Floyd again much less walking into the Criminal Court building to talk about why his attorneys think he should not have had to stand trial."
