(WBBM NEWSRADIO) — The legal battle continues over claims that Trump International Tower and Hotel polluted the Chicago River, with the Trump Organization now arguing that they shouldn't be the ones to cover the cost of pollution cleanup.

The state of Illinois sued the Trump Organization in 2018, when officials claimed Trump Tower was polluting the Chicago River by withdrawing water for the building's cooling system and discharging pollutants back into it.

Additionally, the Sierra Club and Friends of the Chicago River sued the Trump Organization and claimed it underreported the rate at which the building withdrew water from the river.

According to Crain’s Chicago Business, the Trump Organization has now argued that it has an insurance policy with Allianz Global Risks that is supposed to cover costs related to pollution including cleanup and lawsuit judgments.

Crain's reported the Trump Organization has taken Allianz to court and accused the insurer of failing to honor the policy.

An Illinois appellate court has previously ruled — in a lawsuit brought by a different insurance company — that Trump Tower's insurers are not obligated to help financially from any outcomes related to the state's lawsuit.
