Laid-off workers await word on pay after suburban company files for bankruptcy

(WBBM NEWSRADIO) -- West suburban workers who found themselves abruptly out of a job last month when their employer filed for bankruptcy are waiting to find out if they’ll get money owed them.

The workers were employed by AmeriMark, which sold home goods, clothing and more both online and by catalog.

But a month ago, the 150 workers were either called and told the business had shut down or they went to work and found the business in Aurora closed, according to Chris Williams, employment law division director for the Chicago Workers Collaborative, which represents the workers.

Williams said workers were left with no job, no thank you, no final paycheck -- no nothing.

“The banks get 100% first before the workers get anything. So, typically in a situation like this, there’s almost nothing left for the workers,” he said.

Williams said many of the workers had been employed by AmeriMark for more than a decade.

Williams says under the Warren Act, workers must get 60 days’ notice of an upcoming layoff or 60 days’ pay in lieu of that notice.

He plans to take part in an online meeting of the company’s creditors next week.
