NEW YORK (1010 WINS) — The New York City Office of the Medical Examiner on Wednesday deemed the death of Jordan Neely a homicide.

A white 24-year-old former marine put Neely, a 30-year-old homeless Black man who was acting erratically, in a chokehold until he lost consciousness on Monday. The OME confirmed that Neely died from compression of the neck.

Neely was yelling at riders that he didn't have any food when he was attacked, but he had not made contact with any other passengers, according to witnesses.

Police initially arrested the attacker, who has not yet been identified, but released him without charging him.

There is still no word whether he’ll be charged now that the OME has deemed the killing a homicide.

The killing caused outrage after video circulated of the attacker choking the homeless Michael Jackson impersonator for several minutes until Neely’s legs stopped moving.

Demonstrators protested the dehumanization of homeless New Yorkers and held a vigil for Neely at the Broadway-Lafayette subway station in Manhattan on Wednesday — the station the F train was approaching when the attack took place.
