Man, 75, and mom of missing girl, 5, in Queens charged: NYPD

NEW YORK (1010 WINS) — Police charged a 75-year-old man and the mother of a 5-year-old girl that was reported missing in Queens on Tuesday, authorities said Wednesday.

Franz Vila was charged with kidnapping in the first degree, abuse with sexual motivation, criminal sex act on a person less than 11 years old, unlawful imprisonment, and acting in a manner injurious to a child, police said.

The girl’s mother, 30-year-old Kimberly Pijuan was charged with endangering the welfare of a child, according to officials.

At about 9 a.m., the girl and her mother were at the Food Town Supermarket located at 76-10 37th Ave. in Jackson Heights when she asked to go to the park, cops said.

Pijuan initially said no but then allowed Vila, an acquaintance to take her daughter instead.

When Vila did not return with the girl by 1 p.m., and they weren't at the park, Pijuan called police to report her daughter missing.

The girl was was found after 4:30 p.m. at 74th Street and Roosevelt Avenue Jackson Heights subway station after a good Samaritan flagged down an officer after he recognized the child and man.

Vila was taken into custody and questioned Tuesday night.

Officials said that say Vila and Pijuan had only known each other for about a month.
