After being told by flight crew multiple times to wear his face mask during the eight hour trip, 29-year-old Shane McInerny allegedly threw an empty beverage can which hit another passenger in the head, according to an affidavit and complaint which was unsealed Friday.

McInerny, a native of Ireland, proceeded to cause more trouble on board by approaching the captain, who was on break, and twice put his hat on the captain’s head. The affidavit also alleges McInerny held his fist near the captain’s face saying “don’t touch me.”

The trouble didn’t stop there. McInerny then allegedly pulled his pants and underwear down to expose his buttocks to a flight attendant, the complaint said.

On final approach to John F. Kennedy International Airportthe complaint said McInerny did not remain in his seat.

McInerny is now facing a felony charge of intentionally assaulting and intimidating a member of a flight crew, said spokesperson for the District Attorney’s Office for the Eastern District of New York John Marzulli. Marzulli added that if convicted, McInerny could face up to 20 years in prison.

McInerny had his first appearance in Brooklyn Federal Court on Jan. 14. He was released on $20,000 bond and must remain in the U.S. as a condition of his bond. No date has been set for his arraignment.
