NEW YORK (1010 WINS) – A 7-year-old boy is facing a rape charge in upstate New York, according to police.
State police told local station WWNY that the boy was charged with third-degree rape on March 23 in connection with an incident reported on Thanksgiving.
The boy is from Brasher Falls, near the New York—Canada border southwest of Montreal.
The boy was released, and the case will be handled in family court, according to the report.
Queens defense attorney Anthony Martone, who handles youth cases, told WWNY that it appears the boy was charged as a juvenile delinquent.
Martone called it "absurd to charge a 7-year-old with rape."
"Instinctually, it shouldn't happen that a 7-year-old—I don't think you even could really realize what you're doing at 7 years old," Martone said.
