Officials say, three employees at an Upstate fast food restaurant can't be prosecuted for food tampering, after an incident from earlier this year. As we previously reported, three people who worked at the Wendy's in Union who were arrested for food tampering, in early June.
That came after a customer reported that a Wendy's employee called her and told her not to eat her food, because it had been spat in. The alleged incident happened in late May, after the customer had sent their food back to be re-made.
The 16th Circuit Solicitor's Office says under state law the workers can't be charged with food tampering. The officer says after reviewing video there was no proof the food was spat in.
Officials say the video shows the food being thrown in the trash can, taken out and then served to the customer. The food was wrapped so it doesn't meet the threshold for food tampering, under state law.
