Texas' favorite rest stop Buc-ee's is no stranger to filing lawsuits, and this time they have a Florida oddities shop in their crosshairs for selling merchandise that seemingly pokes fun at the beloved beaver.
Buc-ee's has an issue with the Winter Park, FL shop Prometheus Esoterica selling merchandise designed in the likeness of the Buc-ee's beaver, as noted in a lawsuit filed May 29.
According to MySA.com, the lawsuit accuses the oddities shop of piggybacking on Buc-ee's hard-earned title as a "household name."
The lawsuit reads, "[Prometheus Esoterica's] unauthorized use of the Buc-ee's Marks is likely to cause confusing among customers. Consumers are likely to perceive a connection or association as to the source, sponsorship, or affiliation of the parties' products and services, when in fact none exists."
Prometheus Esoterica has 21 days from the time the time the lawsuit was filed in late May to submit a formal response
