A state lawmaker is trying to close a loophole that has led to DUI arrests for medical marijuana users.

State Senator Cam Bartollota says Pennsylvania's zero tolerance DUI law doesn't differentiate between medicinal and recreational marijuana.

When a card holder is pulled over, they are subject to DUI even if they aren't impaired.

Blood tests can detect traces of THC even weeks after marijuana use.

Bartollota called it an oversight that has caused a lot of pain.

“We made it legal, we protected employers, we protected people dealing with custody battles, we protected a lot of other people with that legislation, but we left out the fact that we have a zero-tolerance law on the books,” said Bartollota.

Her bill would require proof of impairment as the basis for a DUI conviction.
