In a release the Sedgwick County District Attorney’s Office announced a default judgment against a Wichita area roofing company and its owner “for unconscionable and deceptive acts under the Kansas Consumer Protection Act.” The defendant, Flint Hills Roofing Co. LLC and it's owner Tyler Sims were fined $510,755.40.
According to the DA’s Office, Sims and Flint Hills Roofing are accused of committing 28 violations of the Kansas Consumer Protection Act. These violations included failing to pull permits, skipping inspections and failing to finish contracted projects. In one case a metal roof was replaced using moldy plywood and asphalt shingles. Inspections indicated that structure was unsafe to enter after the "repair." When an insurance company requested additional estimates, Sims provided one from a defunct company that still listed him as an owner and another from a second company using their logo without permission.
The court ordered Sims and Flint Hills Roofing to pay more than $36,000 in restitution and $470,000 in civil penalties, including court costs and investigative fees. In addition both Flint Hills Roofing and Tyler Sims were banned from doing business in the state until the fines are paid in full and their license to operate is reacquired. Sedgwick County District Attorney Marc Bennett issued a reminder to residents that roofers must be licensed by the Metropolitan Area Building and Construction Department and registered on the Attorney General’s Roofing Registry.
