Federal Court Backs Texas Democrats In Mail In Voting Fight

SAN ANTONIO (1080 KRLD) - A Federal Court in San Antonio grants an Injunction on the Texas Democratic Party’s Vote-By-Mail Lawsuit.

Judge Fred Biery of the United States District Court for the Western District of Texas on Tuesday granted the Texas Democratic Party’s motion for preliminary injunction in the vote-by-mail lawsuit.

The decision enables counties to permit the use of absentee ballots for all Texans due to the COVID-19 pandemic. The ruling also prevents Texas Republican Attorney General Ken Paxton from threatening the prosecution of voters.

In the order, Judge Biery wrote: “Citizens should have the option to choose voting by letter carrier versus voting with disease carriers.”

“Today is a victory for all Texans. The right to vote is central to our democracy. This ruling means eligible voters can vote by mail during this pandemic,” saild Texas Democratic Party Chair Gilberto Hinojosa. “It is time for a few state officers to stop trying to force people to expose themselves to COVID-19 in order to vote.”

Texas Attorney General Ken Paxton released the following statement: “The district court’s opinion ignores the evidence and disregards well-established law. We will seek immediate review by the Fifth Circuit Court of Appeals.”

So far the Texas Democratic Party has successfully argued their lawsuit in a Travis County District Court, in the 14th Court of Appeals in Houston, and now in a Federal Court in San Antonio.
