The Texas Supreme Court will hear two cases today that could answer the question if ERCOT be sued, or is it protected by governmental immunity?
The separate lawsuits over entirely different claims hinge on one central question, does the Electric Reliability Council of Texas (ERCOT) enjoy governmental immunity or is it open to lawsuits?
In the first case, San Antonio-owned CPS Energy is trying to sue ERCOT over the massive February 2021 winter storm. CPS's lawsuit is over energy prices and overcharges.
In its case, a court found ERCOT is part of the government and is protected by immunity.
The other case involves numbers. The Panda Energy Company says it built power plants because ERCOT's research showed the need for more power, but revised numbers showed an overcapacity. So Panda sued. In that case, an appeals court said ERCOT was not a governmental entity.
Both cases will determine whether ERCOT is part of the government and whether it can be sued.
