Dallas: Charges dropped against homeless man kicked in the head by paramedic

The Dallas County District Attorney has now dropped the charges against a homeless man who was kicked in the head by a first responder.

The case against Kyle Vess, who was charged with assaulting a paramedic in 2019, after a new body cam video show the paramedic was the aggressor.

Paramedic Brad Cox, who is a trained MMA fighter, is seen kicking Vess in the head after he told police Vess had started a fight. But the District Attorney's office says the video appears to show Cox goading him to fight and that Vess was clearly suffering a mental health episode.

George Milner is Vess' attorney and says now the ball is in Dallas Police chief Eddie Garcia's court.

"It's time for Chief Garcia to reopen on the investigation and see that he is charged with either Aggravated Assault by a public servant, or at a minimum Assault on a disabled person," Milner said.

Vess’ family filed a lawsuit against Cox and the city this year. Cox is currently on administrative leave.
