Navigating Estate Planning: Lessons from the Trenches

In light of National Estate Planning Awareness Week, the complexities of estate settlement have led to a candid reassessment by many, including CBS News money expert Jill Schlesinger.

Jill has recently navigated the process a couple times firsthand.

Estate planning, often underestimated, demands careful attention, Jill told KRLD's John Liddle.

"What I've learned over time is that as much as you think you can try to contemplate as much as you can, there are things that get missed," Schlesinger. "The most important thing is to be intentional in this process."

The core documents crucial to this endeavor include a will, designating assets and beneficiaries, along with naming an executor and, if applicable, a guardian for minor children.

Additionally, a health care proxy and a power of attorney are pivotal, ensuring someone trustworthy can make healthcare decisions and act on your behalf in various circumstances.

"You don't need legal knowledge. You don't even need financial knowledge," Schlesinger pointed out. "But you do need the wherewithal to put up with all the administrative hassle it entails."

Jill emphasizes the importance of not drafting documents in the midst of a health crisis, as this adds overwhelming emotional stress. Instead, there's a recommendation for a Letter of Instruction, covering non-will aspects such as funeral arrangements.

Another strategic move involves utilizing Transfer on Death Accounts, streamlining the asset transfer process and avoiding probate.

The real estate component is highlighted as well, addressing ongoing costs associated with properties left to non-spouses. Considering these factors is crucial, underscoring the need for open communication with loved ones about the estate plan, easing the burden on heirs and providing peace of mind for all parties involved.
