Suspect from police chase and fatal crash on 35E in Red Oak is in jail

The capital murder suspect accused of killing a man while trying to run from police is now out of the hospital and in jail.

29-year-old Gabriel Cerna of Mesquite has been booked into the Dallas County jail on more than $2 million bond. Cerna was wanted for a capital murder that happened on Dec. 29th.

Drug agents spotted Cerna and his girlfriend driving on Jan. 16th. An affidavit says Cerna shoved the woman out of her jeep and a chase started. It didn't end until Cerna hit another car and killed a man on Red Oak.

Police say they shot and wounded Cerna after he refused to drop a gun. Court records show Cerna has a separate charge of endangering a child out in Plano. Ellis County authorities have not yet filed charges for the fatal accident and police shootout.
