
Texas is filing a stand-alone challenge to the Biden administration's COVID-19 vaccine mandate.
Eleven state Attorney Generals have banded together to sue the Biden administration in the 8th circuit court in St. Louis. Texas has filed its challenge in the 5th circuit court in New Orleans.

In a release, Texas Attorney General Ken Paxton called the mandate illegal and unconstitutional.
“The Biden Administration’s new vaccine mandate on private businesses is a breathtaking abuse of federal power,” said Attorney General Paxton. “OSHA has only limited power and specific responsibilities. This latest move goes way outside those bounds. This ‘standard’ is flatly unconstitutional. Bottom line: Biden’s new mandate is bad policy and bad law, and I’m asking the Court to strike it down.”
The mandate is to start January 4th and would require businesses with over 100 employees to require vaccinations or face weekly COVID-19 testing and mask-wearing.
The Administration has turned to OSHA to enforce the requirement. Attorney General Paxton says that is a breathtaking abuse of federal power.
All the states named as plaintiffs are asking that the requirement be stayed until a full review can take place.
