5th Circuit Court of Appeals sends Texas social media law back to federal judge

A federal court is set to reexamine a Texas law aimed at regulating social media platforms, marking a fresh start in a case that has already drawn national attention and political debate.

The law, passed in response to conservative complaints that social media companies were suppressing certain viewpoints, faces scrutiny over its constitutionality. When the case was first reviewed, the U.S. Supreme Court declined to intervene, citing vague challenges to the law.

Brian Owsley, a law professor at the University of North Texas at Dallas, highlighted the potential influence of politics in the proceedings, noting that one platform involved in the lawsuit, X, is owned by a prominent Trump supporter.

"Elon Musk goes to Trump and says, 'Hey, I helped you get elected, can you get your Department of Justice to sort of chime in and help me get the state of Texas off my back?'" Owsley said.

The law remains on hold until courts make a final determination on its constitutionality.
